Bodeguita makes no guarantee of availability or Quality of the Bodeguita services and products and will not be held responsible for any delay, loss or interruption/delay of service or Product Quality of any kind. No information given by Bodeguita, its affiliates or their respective employees will create any warranty. We are not and cannot be responsible for delays or problems caused by our Shippers (UPS, FedEx or USPS). We are not responsible for orders not delivered due to “no one home”. We cannot guarantee that deliveries will meet tight delivery schedules or specific dates. If you need the products by certain specific date, please email us PRIOR to placing your order for confirmation this date can be met. Reference to any products, services, processes, hypertext links to third parties or other information by trade name, trademark, manufacturer, supplier or otherwise does not imply its endorsement, sponsorship, or recommendation by Bodeguita. If any provision of this agreement is declared invalid or un-enforceable, the remaining provisions of this agreement will remain in effect. Bodeguita has the right to modify these terms and conditions at any time. Bodeguita has the right to terminate any user's access to this service at any time without notice. All orders are final, there are no refunds or cancellations once the order has shipped. Governing Law; Dispute Resolution You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Florida without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Broward County, Florida, and waive any objection to such jurisdiction or venue. Any claim under these Terms and Conditions must be brought within one (1) month after the cause of action arises, or such claim (product purchase) or cause of action is barred. No recovery may be sought or received for damages other than the actual price paid to us by you for any of the Products we sell and you have purchased, excluding shipping and handling, each party also agrees to cover it’s own costs and attorneys’ fees regardless of who is the prevailing party. In the event of any controversy or dispute between Bodeguita and you arising out of or in connection with your use of the Site and/or the Products sold directly to you in this Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation in the above indicated venue. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law and these Terms and Conditions and at the specified venue. Users of the Bodeguita Site agree to the above terms as a condition to use any Bodeguita service or purchase of any products.
